QLD Pool Safety in Brisbane

A QLD pool safety inspector’s role is to inspect pools and whether they are compliant to the QDC Queensland Development Code MP 3.4 Pool Safety Standard.

  • If the pool or spa is safe, a Form 23 Pool Safety Certificate is issued.
  • If the pool or spa does not meet the standard, a Form 26 Non Conformity Notice is issued.

A Brisbane pool owner or property manager has up to 90 days from their Pool Inspection to reach compliance before council is notified.

    A Form 24 Pool Safety Certificate is the official document confirming your pool or spa safety barrier meets the applicable Queensland standard.

    A Pool Inspector issues this after a compliant onsite inspection, and it is then lodged with your local council.

    This is the legal proof your barrier is compliant under the Building Regulations.

    Who can issue a Pool Safety Certificate in QLD?

    Only registered building inspectors or Pool Safety Inspectors can issue a Form 24 Pool Safety Certificate.

    A builder, plumber or landlord cannot issue this Certificate.

    How often do I need a Pool Safety Certificate in QLD?
    Every 12 months for a shared pool.
    Every 2 years for a non-shared pool.
    Once your certificate is lodged, you will be notifiied of the renewal date.

    How can I prepare for my pool Inspection?

    You don’t need to do anything complicated with a little preparation to help the inspection run smoothly.

    Before Inspection, make sure the pool area is accessible with clear access to the pool fence, gates and barriers so the Inspector completes the Inspection without delays.

    • Check gates and latches are working and do not self-close. Pool gates should open away from the pool, close by themselves and latch properly every time.
    • Remove climbable objects near the pool fence, such as trees, pot plants, chairs, BBQ, clothes lines or pool equipment near the barrier.
    • Check pool fence height is less than 1200mm or boundary fence height is less than 1800mm
    • Look for loose panels, gaps, damaged fencing or broken gate latches and hinges
    • Distance between the vertical elements of a fence is greater than 100mm
    • Distance below the bottom of the fence is greater than 100mm
    • CPR Cardiopulmonary Resuscitation sign is missing, incorrectly located or out of date

    Collect your property details such as the property address, owner details and pool registration certificate (where required).

    These are the reasons why your pool barrier can fail the Inspection

    What happens if my pool barrier fails the Inspection?

    That’s ok. Pools are frequently not compliant.

    If a Pool Safety Inspector finds a pool does not meet the swimming pool spa fences and barriers safety requirements, a certificate or notice is issued.

    If your pool doesn’t comply, you’ll receive a QLD Form 26 Non-Conformity Notice from your Inspector with up to 3-months to rectify.

    Rectifications may require the skills of a contractor builder. Be sure to pick the right builder who gets the job right the first time and saves you from spending money unnecessarily.

    Failing to Register, Inspect or Lodge a Certificate leads to fines and penalties.

    If a swimming pool or spa barrier or fence is non-compliant and improvement notices are ignored, Council can escalate the matter.

    Beyond the penalties, a compliant barrier prevents children aged 0-5 drowning in backyard pools.

    Can I still sell my home if my pool isn’t compliant?
