What Is a NSW Pool Safety Certificate?
In New South Wales, a Pool Safety Certificate is officially called a Certificate of Compliance. This Certificate is the legal document confirming your swimming pool or spa barrier meets the standards set out in the Swimming Pools Act 1992 and Swimming Pools Regulation 2018.
Certificates are issued by Local Council Officers or Registered Building Certifiers (category A1, A2, A3, or E1) following passing your Inspection.

How Long Is The Certificate Valid For?
A NSW pool safety certificate is valid for 3 years from the date of issue. Once expired, a new Inspection and Certificate is required before selling or leasing.

What is a Certificate of Compliance in NSW?
A Pool Safety Certificate of Compliance is the official document confirming your swimming pool or spa fences and barriers meet the state safety requirements.
In New South Wales, Pool Compliance Certificates are issued by A1, A2, A3, or E1 Certified and Council Pool Safety Inspectors.
The Certificate of Compliance needs to be renewed every 3 years.
If an A1, A2, A3, or E1 Certified and Council Pool Safety Inspector finds a pool does not meet the swimming pool spa fences and barriers safety requirements, a Certificate of Non-Compliance is issued.
After 6-weeks, Council is notified if the property remains non-compliant.
The Certificate of Non-Compliance is valid for 12 months, allowing any necessary rectification works to be completed.
Why do I need a Certificate of Compliance in NSW?
In 2016, NSW laws required all properties with a swimming pool or spa pool to comply with the pool safety laws with valid safety certification, such as
- certificate of compliance
- certificate of non compliance, or
- relevant occupation certificate
A Pool Safety Certificate of Compliance is needed when
- selling or leasing a property with a swimming pool or spa
- building a new swimming pool or spa on a property
- a new fence is being built around an existing swimming pool or spa
- a property is purchased with a pool or spa 90 days from settlement
- running a family day care, home care or at-home child care facility
- requested by your bank applying for or refinancing your home loan, or
- directed by council
Who can issue a Certificate of Compliance in NSW?
Certificates are issued by Local Council Officers or Registered Building Certifiers (category A1, A2, A3, or E1) following passing your Inspection.
A builder, plumber or landlord cannot issue this Certificate.
How often do I need a Certificate of Compliance in NSW?
What safety standard does my pool or spa barrier need to meet?
In NSW, the requirements for pool and spa barriers and fences depend on when the pool was built and where the pool is located.
NSW Fair Trading has 3 pool safety standards – which can be read >here. They are set according to when the pool was constructed
- AS 1926-1986, fences and gates for private swimming pools which applies to pools constructed prior to 30 August 2008
- AS 1926.1 – 2007, swimming pool safety, Part 1 safety barriers for swimming pools which applies to pools constructed between 1 September 2008 to 30 April 2013
- AS1926.1 – 2012, swimming pool safety, Part 1 safety barriers for swimming pools constructed after 1 May 2013

How can I prepare for my pool Inspection?
You don’t need to do anything complicated with a little preparation to help the Inspection run smoothly.
Before Inspection, make sure the pool area is accessible with clear access to the pool fence, gates and barriers so the Inspector completes the Inspection without obstructions or delays.
- Check gates and latches are working and do not self-close. Pool gates should open away from the pool, close by themselves and latch properly every time.
- Remove climbable objects near the pool fence, such as trees, pot plants, chairs, BBQ, clothes lines or pool equipment near the barrier.
- Check pool fence height is less than 1200mm or boundary fence height is less than 1800mm
- Look for loose panels, gaps, damaged fencing or broken gate latches and hinges
- Distance between the vertical elements of a fence is greater than 100mm
- Distance below the bottom of the fence is greater than 100mm
- CPR Cardiopulmonary Resuscitation sign is missing, incorrectly located or out of date

How long does a pool Inspection take?
Armed with a tape measure, your Pool Safety Inspector completes an onsite inspection within 25-45 minutes, depending on the size of the pool area, the type of fencing, the condition of gates and latches and whether there are any non-compliant issues to address.
During the inspection, the Pool Safety Inspector checks fence heights, gaps, gate operation, latch heights, climbable objects, and overall compliance with Australian Standards.
If non-compliance issues are found, additional time may be needed for Reinspection once repairs are completed.
If you’re worried you won’t understand what issues you need to address, you are emailed a detailed report including photos and vidoe with descriptions and explanations on rectifications.

What are the reasons my pool can fail the Inspection?
- Gate hinges and/or latches are faulty or do not self-close
- Climbable objects are too close to a pool fence, such as trees, plant pots, BBQs and clothes lines
- Pool fence height is less than 1200mm or boundary fence height is less than 1800mm
- Distance between the vertical elements of a fence is greater than 100mm
- Distance below the bottom of the fence is greater than 100mm

What happens if my pool fails the Inspection?
That’s ok. Pools are frequently not compliant.
If a Pool Safety Inspector finds a pool does not meet the swimming pool spa fences and barriers safety requirements, a certificate or notice is issued.
If your pool doesn’t comply, you’ll receive a Certificate of Non-Compliance from your Inspector with up to 12-months to complete Rectifications. Legally, Council requires notification after 6-weeks after the First Inspection if your pool remains non-compliant.
Rectifications may require the skills of a contractor builder. Be sure to pick the right builder who gets the job right the first time and saves you from spending money unnecessarily.

What are the penalties for not having a compliant pool barrier?
Failing to Register, Inspect or Lodge a Certificate leads to fines and penalties.
If a swimming pool or spa barrier or fence is non-compliant and improvement notices are ignored, Council can escalate the matter.
Beyond the penalties, a compliant barrier prevents children aged 0-5 drowning in backyard pools.
Can I still sell my home if my pool isn’t compliant?
In NSW, a swimming pool or spa needs a Certificate of Compliance or Certificate of Non-Compliance to be attached to the Sales Contract. If non-compliant, the new property owner is obligated to rectify all pool compliance issues within 90-days of settlement.
A Certificate of Compliance needs to be attached to the Residential Tenancy Agreement prior to leasing the property.
A Certificate of Compliance needs to be renewed every 3 years.

Can I still rent my home if my pool is not compliant?
Rental properties with a swimming pool or spa must be compliant before tenants move in.
If your pool is not compliant, councils and regulators can issue fines, notices or prevent leasing until compliance is achieved.
