What Is A Pool Safety Certificate?
A Pool Safety Certificate is an official legal document confirming your pool barriers, fencing, gates and latches meet Australian safety standards and state regulations – reducing the risk of unsupervised access by children under five.
Only a licensed Pool Safety Inspector or authorised Council Inspector can issue your Pool Safety Certificate.
QLD - Form 23 Pool Safety Certificate
Valid 2 years (non-shared pools), 1 year for shared pools (hotels, resorts, caravan parks).
If your property isn’t compliant at sale, a Form 26 Non-Conformity Notice gives the buyer 90 days post-settlement to rectify.
NSW - Certificate of Compliance
Valid 3 years. A failed inspection results in a Certificate of Non-Compliance, giving the new owner 12 months to meet the standard.
VIC - Certificate of Barrier Compliance
Valid 4 years. A failed inspection results in a Certificate of Barrier Non-Compliance, with 7 or 60 days for rectification, depending on the works required.
When Do You Need a Pool Safety Certificate?
Selling
A property sale with a pool can’t proceed without a Pool Safety Certificate attached to the deed – or a Non-Conformity Notice (QLD) or Certificate of Non-Compliance (NSW) confirming the buyer takes on responsibility within 90 days of settlement.
Renting
Your pool barriers must be certified compliant before a tenant moves in.
Buying
If you’ve purchased a property with a pool, you have 90 days from settlement to obtain a certificate.
Building
New pool, new spa or new pool fence on an existing property – a certificate is required before use.
Refinancing
Your bank can request an up-to-date Pool Safety Certificate before approving or refinancing a home loan.
Running a childcare facility
Family day care, home care or at-home childcare operators require a current certificate confirming the pool meets safety standards.
